Legal counsel at the Investigations Office

WHERE WILL YOU BE WORKING?

You will be assigned to the Investigations Office. This department is headed by the investigations officer of the FSMA.

Where the FSMA identifies, in the course of carrying out its legal mandate, serious indications of a practice that could give rise to an administrative sanction, the Management Committee of the FSMA tasks the investigations officer with investigating the case. The investigation may concern different areas of the FSMA’s supervision. It often relates to insider dealing and market manipulation, but may also target infringements identified in a number of other areas, such as those governed by the prospectus legislation and MiFID conduct of business rules.

WHAT WILL YOUR JOB ENTAIL?

As a rapporteur within the Investigations unit, you will be responsible, under the supervision of the investigations officer, for:

  • Handling the dossiers for which an investigation has been initiated.
  • Carrying out the investigative actions necessary to identify the relevant facts.
  • Drawing up written requests for documents and factual information.
  • Conducting hearings of the persons concerned and of witnesses, or requesting telephone data.
  • Cooperating with foreign supervisory authorities.
  • Analysing the facts of the cases from a legal perspective.
  • Drawing up investigation reports objectively and in compliance with the applicable procedural rules.
  • Presenting the investigation dossiers to the FSMA’s Sanctions Committee. 

WHAT KNOWLEDGE, EXPERIENCE AND SKILLS DO YOU BRING?

  • A Master’s degree in law.
  • Familiarity with financial legislation or the willingness to acquire such familiarity in the short term.
  • 3 to 5 years’ experience in civil, criminal or administrative law.
  • An analytical mind combined with an excellent capacity for synthesis. 
  • Solid competence in Dutch and French.
  • Ability to communicate in a clear and structured manner both verbally and in writing. 
  • Ability to work independently and as part of a team.
  • Professionalism: competence, precision and commitment to advancement.
