This section includes the list of legal entities established in Belgium that, as at 1 May 2022, offer exchange services between virtual currencies and legal currencies and/or custody wallet services and that have notified the exercise of such activities within the deadlines laid down in Article 20 of the Royal Decree of 8 February 2022. These entities are permitted to exercise these activities on a provisional basis until the FSMA has made a decision about their application to be enrolled in the register of providers or exchange services between virtual currencies and legal currencies and/or in the register of custody wallet service providers.

A provisional authorization is not equivalent to registration in the aforementioned registers.

As a result, the FSMA has not yet checked whether the entities on the list below have met the conditions for registration that concern certain aspects defined by law, such as the verification of the fitness and propriety of their senior managers required for holding their position, the provider’s organization, or the qualities of certain shareholders of the service provider required with a view to guaranteeing sound and prudent management and compliance with the rules on combating money laundering and terrorist financing.

We wish, moreover, to draw your attention to the fact that neither the provisional authorization nor even enrolment in the register of virtual asset service providers guarantees the application of a specific protection regime for the clients of these providers, nor the quality of the services they offer.

We wish also to remind you that virtual currencies are subject to significant price fluctuations, which can give rise to substantial financial losses. Holders of virtual currencies might also lose their money as a result of hacking. Lastly, under no circumstances do the laws and regulations governing registration of virtual asset service providers and their supervision by the FSMA confer on virtual currencies the status of legal tender.
