New legislation governing crowdfunding service providers

The Law of 23 February 2022 Implementing certain aspects of Regulation (EU) 2020/1503 on crowdfunding service providers subjects the crowdfunding service providers governed by the Regulation to the supervision of the FSMA. The Law of 18 December 2015 on the recognition and delineation of crowdfunding has therefore been completely replaced by this new legislation.

Any applicant crowdfunding service provider that falls within the scope of the Regulation can, as from now, submit an application for authorization.

The FSMA’s website has thus been updated and includes:

  • New FAQs on the conditions for authorization and on the conduct of business rules;
  • The forms provided by the FSMA to facilitate the preparation of an application for authorization.
