Since 2 August 2022, the client’s sustainability preferences figure among the information to be collected as part of the suitability test under MiFID II.

The Boards of Supervisors of EIOPA and ESMA, in which the FSMA participates, have respectively approved a ‘guidance’ and ‘guidelines’ about this subject which are aimed at facilitating the implementation of those new requirements by the financial institutions. You can find those texts on the websites of EIOPA and ESMA.

The ESMA guidelines will be translated and the competent national authorities will have two months to confirm whether they intend to integrate these guidelines into their supervisory practices.
