Publication of opinion regarding the scope of the mandatory settlement of the supplementary pension

The FSMA has published an opinion (available in French or Dutch) on the scope of the mandatory settlement of the supplementary pension at the time of legal retirement (Article 27, §1 of the Law on Supplementary Pensions (WAP/LPC)). According to this opinion, a pension institution may not charge any fees specifically for this service. Likewise, this may not be considered a repurchase, even if the settlement of the supplementary pension at the time of legal retirement takes place before the contractually agreed retirement age. Such settlements are in fact simply the fulfilment of a legal obligation. This does not, in other words, involve a termination of the pension contract by the policyholder described in Annex 2, point 24 of the Royal Decree of 14 November 2003 on Life Insurance.
