If you have a question or complaint about a supplementary occupational pension (second pillar pension), we advise you to first contact your employer's human resources department or the complaints department of the pension company (insurer or pension fund), that manages your pension scheme.
- If your supplementary pension is managed by an insurance company, it is useful to know that Belgian insurance companies have a complaint procedure described on their website or in the general terms and conditions of the insurance contract. For advice regarding your specific situation, you can also contact your trade union or a lawyer. If, after taking these steps, there continues to be a dispute, you can contact us, the Financial Services and Markets Authority (FSMA).
Complaints have an important signalling function for the FSMA as a supervisory authority. The FSMA supervises compliance with the legislation governing supplementary pensions and can offer its interpretation of that legislation. If the FSMA identifies infringements of the legislation governing supplementary pensions, it takes action.
- However, the FSMA cannot take a position on contractual disputes: only labour courts are competent to do so. For example, the FSMA cannot take a binding decision if a dispute arises as to the interpretation of the pension scheme.
- Nor can the FSMA offer advice on the personal choices you have to make.
- The FSMA does not intervene in disputes in which you yourself, your employer or the pension institution has gone to court.

- Lodging a complaint with the FSMA does not interrupt the limitation period.
